The Black Floridian woman who was facing 20 years in prison for shooting warning shots at her abusive ex-husband is reportedly offering conditions to a judge if she is released.
Marissa Alexander’s attorneys are trying to get her home in order for her to spend the holidays with her 3-year-old son. If granted bail, Alexander has agreed to adhere to an 8 p.m. to 7 a.m. curfew, not contact her estranged husband, Rico Gray, and live in a halfway house or under 24-hour house arrest.
“While the state bears the burden to prove that ‘no conditions’ can ‘reasonably protect,’ it has made no showing whatsoever that the conditions Alexander has proposed are insufficient to keep Gray safe,” wrote Alexander’s attorneys in the filing.
In August 2010, Alexander’s ex-husband assaulted her, prompting her to fire her weapon. During the incident, the ex-husband threatened to kill her. Alexander was pregnant at the time. Angela Corey, who is the prosecuting attorney in the case, was also the prosecutor in the George Zimmerman case.
Reports indicate that Alexander was beat by her husband while she as pregnant. After being beaten, she fired a pistol, and the bullet traveled through a wall and into the ceiling. Her lawyers said firing the weapon saved her life and that she had a gun permit and was properly trained in how to use the weapon.
Court documents state that Alexander is no longer a threat to her estranged husband and that he is the one who is dangerous. Alexander’s defense team claims the man threatened witnesses and have text messages to support their claim.
However, the prosecution said the texts are hearsay and that they do not prove Alexander is a threat to her own children.
“She presents nothing in the way of cause—good, fair or even marginal—to believe she has suddenly ceased to be a threat; that she would suddenly respect, rather than defy, court orders; that she would suddenly cease her attempts to intimidate, seduce or otherwise persuade victims to support her claims,” wrote the state attorney’s office.
