Reports indicate that the five suspects accused of raping a woman in Brownsville, Brooklyn have been released by order of a judge.
The suspects, whose ages range between 14 and 17, are still being charged with rape. Four of the teens were freed because they cannot be held without an indictment. Another is being held on unrelated assault charges.
All five teens are accused of walking up to an 18-year-old women and her father in Osborn Park with a gun. The father allegedly fled the scene after the teens threatened him before raping the woman.
“Because we are determined to get to the truth about what happened in that park, we need more time to investigate this complex case and gather more evidence. So, therefore, we have consented to the defendants’ release,” Brooklyn D.A. Kenneth Thompson said in statement.
Evidence on the teens’ cellphones, which reportedly contains footage before the incident, and DNA is playing a role on whether or not they will be indicted.
The suspects are able to go home and back to school. The case will be dropped in six months if prosecutors don’t file an indictment.
