Arthur Sumpter paid a visit to Dive 75 on March 12, 2019 as a triumphant man. By then, he had clocked two decades of working in data analytics, which paid the bills. But his true passion was stand-up comedy. Earlier that night, Sumpter performed a “particularly amazing” five-minute set at Carolines on Broadway— no easy task for a beginner.

He started his celebration with five friends with wine immediately after the set. When his buddies started to bicker, Sumpter decided to round out the night alone by grabbing a drink in a calmer environment and enjoy his success peacefully. He headed to Dive 75, assuming the Upper West Side bar would be vacant on a Monday Night.

Then-FDNY lieutenant Ryan Brito also found himself at Dive 75 that night, albeit with less deliberation. He was a regular. Brito was also celebrating a special night: His friend, a fellow firefighter James De Leon now retired in California, was visiting to watch his nephew perform a concert at Carnegie Hall. The two met at the bar and were later joined by De Leon’s family and Brito’s romantic partner. 

None of the bar’s patrons were in high spirits by the night’s end. Sumpter was taken from Dive 75 in handcuffs, while Brito and De Leon were taken to a hospital for knife wounds. Brito’s injuries in particular were life-threatening. 

Last month, a jury found Sumpter guilty on all four charges against him: first degree assault, attempted first degree assault, second degree assault and fourth degree criminal possession of a weapon. Today, he will count down to his April 22 sentencing date on Rikers Island, remanded last month after the conviction, despite his ex-lawyer’s request to keep him on bail to handle his personal affairs.

Brito, who was not charged, missed nearly a year of work while recovering from injuries sustained that night. After he returned to his post, he was promoted to FDNY Captain last year.

Witnesses gave differing accounts of what they saw during the trial which was held this past March. But most agree that tensions began to brew when Sumpter approached Brito’s party to address a dispute over collecting the belongings of a woman he met at the bar. 

As shown by surveillance footage, Brito is initially off to the side talking with De Leon, but soon inserts himself, animatedly. In his testimony, the firefighter said he frequently “talks with his hands.” Regardless, pointing and waving accompanied his words, as seen in surveillance footage from the bar.

The bartender beckoned Sumpter to close out and leave. He does, after another extended exchange. Witness testimony and surveillance video both track Brito following Sumpter out. Sumpter pulls out his knife as the firefighter “barrels” toward him, and a physical altercation ensues. De Leon is shown attempting to get between them as other patrons add to the fray, eventually holding Sumpter over a railing as they try to wrest the knife from him. When police arrive, Sumpter is pinned to a car by several men. 

During the trial, Sumpter told the courtroom that he carried a knife out of fears of anti-Black and far-right violence, pointing specifically to an October 2018 incident on the Upper East Side that led to two Proud Boy members being convicted of attempted gang assault. The incident, Sumpter said, happened just a few blocks from the Target and Best Buy he regularly shopped at.

He said he followed the legal parameters while shopping for the weapon through a “layman’s Google perspective,” ensuring the blade was not too long and did not retract. Knives “are not illegal, but become illegal based upon how they are used or possessed,” according to the NYPD

Witnesses offered varying perspectives on what prompted the fight at Dive 75. Sumpter’s defense maintained he played rounds of Connect Four with a woman he met there, while prosecutors and Brito’s supporters argued Sumpter had more amorous intentions for the woman and that Brito stepped in to help get her home safely. The woman, identified as Katherine Sammis, ended her night hospitalized with a high alcohol blood volume and was treated with sedatives. 

A bartender called to testify recalled Sumpter and the woman chatting before she invited him to play Connect Four; the bartender said he also noticed her talking to Brito’s partner after leaving for the bathroom. Sammis herself testified that she thought Sumpter was hitting on her and asked Brito’s party if she could stand with them while she used her phone to order an Uber ride. She said she could not recall other details, pointing to “drinking a lot.”

Throughout the trial, Sumpter’s defense attorney alleged potential racial bias during the incident against his client, citing a 2018 federal discrimination lawsuit against the FDNY that named Brito as a defendant. The City ultimately settled with the plaintiff for $80,000

In the complaint, a former would-be firefighter accuses Brito of pressuring him to leave the department during his probationary period, “on account of his race and his perceived homosexuality.” The trainee, who is Hispanic, alleged that Brito, who also identifies as Hispanic, and another firefighter “ganged up” on him for leaving a funeral early, even as white colleagues who also took off prematurely were not subjected to similar treatment. 

Brito and another firefighter are also named in the complaint for allegedly berating the plaintiff for playing Pokémon Go, an augmented reality spinoff of the long-running franchise where players travel public spaces “catching” the fictional creatures. Days later, the trainee allegedly found a fake sign-in sheet containing an anti-gay slur that mockingly invited others to play Pokémon Go with him.

During the trial, Sumpter’s defense said the settlement was reflective of internalized racial bias and discrimination that fueled the Upper West Side incident. Brito denied any discriminatory views played a role in the confrontation, as well as denying any allegations of bullying the trainee in the previous case. He told the courtroom that his father, who is Mexican, came out as gay later in life. 

Then there’s the matter of self-defense. Witnesses, which mostly comprised of the other patrons who pinned down Sumpter and attempted to disarm him, gave differing accounts of whether Brito and De Leon hit him while trying to subdue him. Sumpter was later held in pre-arraignment detention for three days after the incident, and it remains unknown if he sustained any injuries in the fracas—although an officer did ask him to raise his shirt.

In his testimony, Brito admitted to running after Sumpter despite convincing him to leave the bar and “barreling” through the bar entrance, saying he was “manipulated” by Sumpter taunting him. Surveillance video shows the two continuing to exchange words while Sumpter finishes his beer and backs out of the bar. Brito did say in cross-examination that he made the “first aggressive move.” He said he was aware that Sumpter was carrying a knife when he rushed at him, informed by one of the other patrons after stepping outside previously during the exchange. But Brito said he did not think Sumpter would use it. 

Sumpter’s family said that they believed he acted in self-defense and also believed racial bias was present during the incident. 

“Arthur now has a new legal team and much more will be coming soon, including all actively seeking for Arthur Sumpter’s recent verdict at trial to be set aside before his sentencing, which is currently scheduled on 4/22/24 in Manhattan,” the family said in a statement released to the media. “Many are now fighting his recent conviction. Arthur—we love you and we support you.”

The FDNY declined to comment. Brito did not respond to attempts to reach him. (TK if things change).

Do not hurry over the fact that A WOMAN ASKED FOR HELP TO GET HOME AND AWAY FROM ARTHUR (CURTIS) SUMPTER JR. After a LONG period of Mr. Sumpter unsuccessfully trying to take home the woman he became upset. He then turned his attention taunting Ryan Brito. Trial testimony of more than one witness saw Arthur (Curtis) Sumpter Jr. HOLDING A KNIFE INSIDE THE BAR. Careful review of this small portion of the full video shows Arthur (Curtis) Sumpter Jr. exits the bar, turns around with the knife in his hand and stabs two men before they reach the bottom of the stairs. If Mr. Sumpter was trying to leave, why would he turn around, position himself, and start stabbing? Why not leave during the 5-10 minute negotiation to take home the girl SAID NO and sought help from strangers. The facts are that Arthur (Curtis) Sumpter Jr. was convicted on 4 out of 4 counts by a jury and a respected judge after a lengthy trial. This is not Arthur (Curtis) Sumpter Jr’s first arrest or even his first assault. New York has one less bad guy and women are safer for it. It’s shameful that crime victims have to be victimized again with slanderous social media planted by PR firms. I’m surprised that credible news organizations take PR stunts seriously.

  2. Let’s not forget the arrest record shows that Arthur Sumpter had ZIPTIES in his pocket. So on the night in question, he had zipties and a knife. When he encountered a woman with levels of intoxication requiring hospilization he refused to let her leave when she said no?? When she asked strangers for help getting home he stood between the woman helping her, her, and the door with a KNIFE in his hand!

    Even intoxicated she knew she wasn’t safe and needed help getting away. Thankful others were there to help ensure there was a safe way to exit. It is a shame their names are being blasted with unfound allocations.

    Victims really don’t receive any protection from media.

  3. When citizens get involved you’re either labeled as a hero or slandered. The video shows a group of citizens coming together to disarm one man, Arthur. In the testimonies it was made clear Arthur said he was going to be right outside. The video shows him backing up with a knife, likely to wait outside, with said knife, like he promised the bar room. Bravery took action to disarm. As the article points out and police report shows, Arthur wasn’t hit or injured at all, he was held up against a car until police arrived. Only the citizens who fought to disarm him faced life threatening injuries.

  4. I’m glad to see there are still people willing to help someone in need. I can’t help but think that the woman in the bar could’ve been my own daughter. To the author – Articles like this will prevent people from getting involved, it may help you to start picturing the woman in the bar as a member of your family and not glaze over the fact she asked for help.

  5. I STAND WITH RYAN BRITO, JAMES DE LEON, AND KATHERINE SAMMIS.

    The jury’s verdict of guilty on all 4 charges emphasizes the seriousness of Sumpter’s actions and the need for accountability. It’s unfortunate that we are seeing such weak attempts to deflect responsibility by claiming racial bias or discrimination. These narratives only detract from the true victims of this incident: Katherine Sammis, Ryan Brito, and James De Leon.

    We must remember these CRUCIAL details:
    1. Katherine Sammis was just trying to enjoy her night out when Arthur Sumpter’s unwelcome advances made her uncomfortable. As a woman myself, I know that it takes a lot to reach out to strangers in a moment like that—especially in a vulnerable state. But evidently, she sought out Brito’s group because she knew that she did not want to be involved with Sumpter.
    2. Other patrons told Brito that Sumpter was holding a knife inside of the bar. This undermines any argument suggesting that Brito’s actions somehow provoked Sumpter. Sumpter’s decision to bring out the knife IN THE BAR and then use it shows a serious lack of regard for everyone’s safety, and dismantles the loose claim that this was an act of “self defense.”
    3. At the 0:07 mark of the video when Brito goes outside, Sumpter ALREADY HAD THE KNIFE IN HIS HAND and ALMOST IMMEDIATELY BEGAN SWINGING AT HIM WITH THE KNIFE. Sumpter’s actions here were clearly a disproportionate response to Brito exiting the bar. Moreover, if Sumpter was attempting to leave, as he had been asked to do, why did he wait there, if not to instigate?
    4. The fact that Arthur Sumpter had zip ties in his pocket raises serious questions. WHO CARRIES ZIP TIES IN THEIR POCKETS? I can assure you, no individual with good intentions is leaving their home, going to a comedy show, and then going to a bar with zip ties and a knife in their pocket. To me, this shows he had ill intentions that night. I fear for what would have happened to Sammis if (a) she had not sought out help or (b) if Brito and De Leon had not been valiant enough to help her.
    5. Arthur Sumpter has been arrested for assault before. Tandy Lau (author) chose to report on Brito’s history, but clearly decided to leave out Sumpter’s unfavorable past. Next time you are writing and running a story, maybe aim for a little more objective reporting and include the FULL STORY.

    Brito, De Leon, and Sammis should not be subject to this kind of speculative narrative. Instead, we should focus on the facts presented during the trial and the experiences of the individuals directly impacted by Sumpter’s actions. As a community, we must prioritize supporting the victims and holding criminals accountable for their actions.

THANK YOU to Sammis for being courageous enough to speak up. THANK YOU to Brito, De Leon, and others for your bravery and willingness to get involved to help an innocent woman. I can’t even fathom the mental anguish you have all felt over the last FIVE+ years since the incident. None of you deserved this.

    I hope that justice will be served on April 22nd.

  6. Wow look at all these not racist racists caping for the supposed victims with their suppositions and innuendos. Bottom line is – when he left they didn’t have to follow him and it would have ended. But of course they “feared for their lives” so they had to follow him outside TO ESCALATE THE FIGHT. And you damn skippy, I would have pulled my knife out too – if I have a bunch of dudes following me outside to fight me after I left. The stuff with the wonman inside the bar was just b******* they came up with afterwards to justify their actions. And as for innuendos with the zip ties, y’all are truly disgusting.

    1. Arthur was with a highly intoxicated woman who ended up hospitalized for high blood alcohol levels
    2. The woman wanted to go home WITHOUT Arthur
    3. Arthur wouldn’t take NO for an answer
    4. The woman asked for help getting home safely away from ARTHUR
    5. Arthur followed the women to the other side of the bar as they gathered their things demanding that she leave with him
    6. Arthur stood between the women and the door
    7. Arthur began to antagonize the patrons that stood up for her
    8. Arthur was reminded that NO means NO
    9. Arthur was asked to leave by the bartender and refused
    10. Arthur took out a knife and stood between the patrons and the door
    11. Arthur’s knife was ILLEGAL for concealment – it was NOT retractable
    12. Arthur threatened to wait outside to fight
    13. Arthur had the knife in his hand as he demanded a fight
    14. Arthur was not injured
    15. Arthur was disarmed and held until police came
    16. Arthur had zipties in his pocket
    17. Arthur was convicted on ALL counts by a 12 person jury
    18. Arthur has been arrested SEVERAL times including assaults in North Carolina and Florida
    19. Arthur has a famous sister with access to funds and media

    The Victims
    1. Were asked to help
    2. Didn’t have any weapons
    3. Didn’t use the weapon Arthur had against him
    4. Called the police
    5. One suffered life threatening injuries
    6. One suffered several stab wounds
    7. All including the establishment are being slandered and harassed in an effort to change the narrative
